REGULATIONS of the SELKEA Sales Platform / Store / Internal Employee Sales
The online store is operated by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., with its registered office at: ul. Radziwiłłów 136, 32-084 Aleksandrowice, District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register (KRS): 0000695288, NIP: 6772425429, REGON: 368291794, BDO: 000144377.
I. Definitions
The terms used in the Regulations mean:
Seller / Guarantor – SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., with its registered office at ul. Radziwiłłów 136, 32-084 Aleksandrowice, District Court for Kraków-Śródmieście in Kraków, XII Commercial Division of the National Court Register (KRS): 0000695288, NIP: 6772425429, REGON: 368291794, BDO: 000144377.
Online Store / Store – a website through which the sale of Goods takes place, operating at the www address provided in the Sales Schedule. Transactions do not involve the physical presence of either party, and the sale is conducted via the Internet.
Customer – a natural person, legal person, or organizational unit without legal personality but granted legal capacity by specific regulations, who places an Order within the Store.
Civil Code – the Act of April 23, 1964 (Journal of Laws of 2024, item 1061), as amended.
Regulations – these Regulations for the provision of services electronically within the Online Store.
Goods – Equipment as defined in the Agreement. Used Goods are graded based on their visual and technical condition. Depending on the assessment by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., they are assigned grades A+, A, A/A-, A-, B, and include a description of their visual and technical condition for each grade. Photos of all Goods are illustrative and do not represent the actual condition or appearance of the Goods. Information about Goods provided on the Store’s website, particularly their descriptions, technical and functional parameters, and prices, constitutes an offer within the meaning of the Civil Code.
Sales Schedule / Employee Sales Schedule – a document sent to the Customer’s employer no later than the business day preceding the Store’s launch, specifying, among other things, the website address through which the sale of Goods takes place and the dates of the Store’s launch and operation.
Sales Agreement – an agreement for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, using the Store’s online service.
Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws of 2024, item 1796), as amended.
Electronic Services Act – the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws of 2024, item 1513), as amended.
Order – a Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods. Placing an Order by the Customer immediately concludes the agreement. By completing the Order form, the Customer accepts the offer to purchase specific Goods and consents to the processing of their data for the purpose of order fulfillment by the Seller and companies cooperating with the Seller.
Cart – a type of form through which the Customer places an Order.
Registration – the submission of personal information by the Customer to purchase Goods.
Account – a profile created by the Seller enabling the Customer to purchase Goods. The Account name is fixed and non-deletable.
Price – the cost of purchasing the Goods. The Price does not include the cost of delivery. The Price is expressed as a gross amount, including the applicable VAT rate.
Delivery Cost – the total cost of delivering the purchased Goods to the Customer, specified by the Store’s website in the Cart section.
Warranty – the activities and duration during which the Customer receives technical support from the Seller/Guarantor.
II. General Provisions
2.1. These Regulations define the rules for using the Online Store.
2.2. These Regulations are the regulations referred to in Article 8 of the Electronic Services Act.
2.3. The Online Store is operated by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., with its registered office at ul. Radziwiłłów 136, 32-084 Aleksandrowice, District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register (KRS): 0000695288, NIP: 6772425429, REGON: 368291794, BDO: 000144377. The owner also holds property rights, including copyrights. Photos of Goods, descriptions, trademarks, and other website elements are the property of the Store and are for advertising purposes. Using them without the owner’s consent is prohibited and may result in legal consequences.
2.4. Using the Online Store requires the Customer’s ICT system to meet the following minimum technical requirements:
a) Internet Explorer version 8.0 or later with Java enabled, or
b) Chrome version 14 or later with Java enabled,
c) Minimum screen resolution of 1280 x 1024 pixels,
d) An active email account, e.g., xxx@xxx.xx.
2.5. Before placing an Order, the Customer must familiarize themselves with these Regulations.
2.6. Used/leased Goods: The Seller ensures their proper functioning unless otherwise stated in the listing. The Seller provides the Customer with a quality warranty for the Goods for 12 months from the date of delivery to the Customer, unless otherwise stated in the listing and subject to the provisions of point 7.6.4 of the Regulations.
2.7. Before handing over the equipment for repair (to exercise warranty rights), the Customer must independently back up data from the hard drive or other storage medium.
2.8. Customers can access these Regulations at any time via a link on the Store’s homepage.
III. Registration in the Store
3.1. Logging into the Store is done using the login and password for the Account provided to the Customer by the Seller.
3.2. Registration in the Store involves the Customer providing personal information. The Customer provides their first and last name, email address, phone number, delivery details, and other contact information they wish to share with the Seller.
3.3. The Account belongs to the Customer. It should not be shared with third parties. For businesses, the Account may be shared in accordance with internal company regulations.
3.4. Registration in the Store and the use of its functions are free of charge.
3.5. The Store allows for the deletion of a Customer’s Account. To do so, the Customer must send an email to info@selkea.pl, including all Account details in the message.
IV. Order Fulfillment
4.1. Orders for Goods from the Store can be placed via the Account.
4.2. Placing an Order via the Account involves using the Cart function. The Customer selects the desired Goods from the Store’s website and clicks the “add to cart” button. The website automatically guides the Customer through subsequent steps, where the Customer specifies the Cart contents, Goods specifications, accepts the Price of the Goods, selects the delivery method, accepts the Delivery Cost, provides the delivery address, chooses the payment method, and confirms the order via the website.
4.3. An Order placed by the Customer via the Account is an expression of the Customer’s intent to conclude an agreement and pay for the Goods. The Sales Agreement is concluded upon the Customer placing the Order.
4.4. Goods are shipped and delivered via an external courier company – DHL, InPost, or another. The Delivery Cost is borne by the Customer. Delivery of Goods is available only within Poland.
4.5. Proof of purchase – a fiscal receipt or VAT invoice is included with every shipment, also serving as a warranty document.
4.6. Purchases in the Store can be paid for in the following ways (at the Customer’s choice):
a) By bank transfer to the following account, based on a proforma invoice or Order number:

b) Via an online payment link on the Store’s website.
4.7.1. Placing an Order as defined in the Regulations by a Consumer involves voluntarily providing personal information:
- First and last name
- Address
- Email address
- Phone number
4.7.2. Placing an Order as defined in the Regulations by a non-Consumer Customer involves voluntarily providing personal information:
- Company name and NIP number
- First and last name of the person placing the Order
- Company address
- Email address
- Phone number
4.7.3. Goods will be delivered to the Customer as soon as possible, and in any case, no later than five (5) business days from the date of placing the Order by the Customer.
V. Withdrawal from the Agreement
5.1. A Customer who, under the Consumer Rights Act, is a Consumer and makes a purchase in the Store may withdraw from the Sales Agreement without stating a reason within 14 days from taking possession of the Goods, except for equipment delivered separately, in batches, or in parts. In this case, the withdrawal period is counted from the receipt of the last batch/part.
5.2. The Consumer must return the equipment to the Seller at their own expense and responsibility, no later than 14 days from the date of withdrawal from the agreement. The Consumer bears only the direct costs of returning the Goods to the Seller.
5.3. The Consumer is liable for any reduction in the value of the Goods resulting from using the Goods beyond what is necessary to ascertain their nature, characteristics, and functioning, unless the Seller failed to inform the Consumer of the right to withdraw from the agreement in accordance with legal provisions.
5.4. The Store will refund all payments made by the Consumer no later than 14 days from receiving the Consumer’s statement of withdrawal from the agreement and after receiving the Goods back. The Store will refund payments using the same payment method used by the Consumer, unless the Consumer expressly agrees to a different refund method that incurs no additional costs.
5.5. The Goods must be returned or delivered to: SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., ul. Radziwiłłów 136, 32-084 Aleksandrowice, promptly, and in any case, no later than 14 days from the date the Customer informed the Seller of the withdrawal. The deadline is met if the Customer sends back the Goods before the 14-day period expires.
VI. Complaints
6.1. To file a complaint, the Goods must be sent to SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., ul. Radziwiłłów 136, 32-084 Aleksandrowice.
6.2. The Customer is obliged to inspect the condition of the Goods in the presence of the delivery person, particularly the quantity, completeness, and compliance with the Sales Agreement. In case of technical defects or damage during transport, the Customer must prepare a damage report detailing the extent of the issue, signed by both the Customer and the delivery entity. The Customer should immediately contact the Store’s customer service at info@selkea.pl after such an incident.
6.3. A keyboard layout different from the standard used in Poland does not constitute a defect and is not subject to complaints.
6.4. Photos on the Store’s website cannot be the basis for filing a complaint.
6.5. The Customer’s complaint will be processed by the Seller within 14 days of receiving a complete complaint submission. If the submission is incomplete, the Seller will promptly inform the Customer and provide instructions for completing it.
VII. Warranty
7.1. The repair time by the Guarantor is up to 14 business days from the receipt of the Goods at the address: SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., ul. Radziwiłłów 136, 32-084 Aleksandrowice. This period may change due to the availability of parts for reasons beyond the Guarantor’s control or may be extended due to undisclosed information about liquid damage, third-party interference, or other factors complicating the repair.
7.2. The Customer may report the equipment to the Guarantor via the internal sales platform or by sending a report to info@selkea.pl.
7.3. Warranty rights are limited to requesting repairs of only the basic components of the computer, i.e., motherboard, processor, memory, disk, graphics cards, and LCD matrix, excluding mechanical damage.
7.4. The Customer is responsible for creating backups before submitting the device for repair. The Guarantor is not liable for consequences of restoring factory settings or updating software on the repaired Goods.
7.5. The Guarantor’s warranty does not apply to repairs with parts provided by the Customer or to motherboard repairs damaged by liquid contact.
7.6.1. The warranty is voided by mechanical damage, liquid damage, moisture, damage due to exposure to temperatures or other factors exceeding the manufacturer’s permissible parameters, unauthorized repair attempts, or damage caused by components or factors about which the Customer failed to inform the service, provided these events occurred after the Goods were delivered to the Customer.
7.6.2. To exercise the warranty, the issue must be reported within 14 days of its occurrence, but no later than the last day of the warranty period.
7.6.3. The Guarantor is liable for the Customer’s damages resulting from non-performance or improper performance of warranty obligations, unless such non-performance or improper performance results from circumstances beyond the Guarantor’s control.
7.6.4. The 12-month warranty covers products on the website, except for:
- Class B products: The Seller provides a 6-month warranty for Class B products unless otherwise stated in the product description.
- Printers: The Seller provides a 6-month warranty for printers.
- Batteries for laptops, phones, and other devices: The Seller provides no warranty for batteries.
7.6.5. By submitting equipment for repair, the Customer voluntarily accepts these Regulations.
7.6.6. In the case of an unjustified complaint, the Service may charge the Complainant for testing, transport, time spent, or expert analysis costs.
7.6.7. The warranty is valid only in Poland.
7.6.8. The warranty period begins on the date of delivery of the Goods to the Customer and lasts as specified in the product description or these Regulations. The warranty period is extended by the documented repair time.
7.6.9. For used Goods, the Seller is liable under statutory warranty if a physical defect is identified within one year from the delivery of the Goods to the Buyer. For Consumer Customers, the warranty does not exclude, limit, or suspend the Customer’s statutory warranty rights for defective Goods. Statutory warranty is excluded for Entrepreneurs.
VIII. Personal Data
8.1. The Personal Data Administrator is SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., with its registered office at ul. Radziwiłłów 136, 32-084 Aleksandrowice, NIP: 6772425429, REGON: 368291794. The principles governing the processing of personal data are described in the attached SELKEA Sp. z o.o. Sp.k. Privacy Policy.
8.2. The Customer provides personal data voluntarily, but it is necessary to provide services to the Customer.
8.3. The Seller processes personal data to provide services in various forms, including electronically. The Seller may share the data with third parties to fulfill the Sales Agreement. The Seller may send commercial information to Customers electronically, subject to compliance with legal requirements.
8.4. The Customer has access to their personal data and the right to correct or delete it. Personal data can be corrected or deleted by logging into the Customer’s Account or contacting the Seller via email.
8.5. At the request of judicial authorities or entities entitled to access Customers’ personal data, the Seller may disclose such data.
IX. Final Provisions
9.1. Any disputes between the Seller and a Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be resolved by courts with jurisdiction in accordance with the relevant provisions of the Code of Civil Procedure.
9.2. Any disputes between the Seller and a non-consumer Customer within the meaning of Article 22[1] of the Civil Code shall be resolved by the court with jurisdiction over the Seller’s registered office.
9.3. Matters not regulated by these Regulations shall be governed by the provisions of the Civil Code, the Electronic Services Act, and other applicable provisions of Polish law.
9.4. The Seller reserves the right to amend the Regulations for important reasons, particularly due to changes in legal provisions or technological advancements. Agreements concluded before the amendment shall be governed by the Regulations in force at the time of conclusion.
9.5. The Seller makes every effort to ensure that the services provided are of the highest quality. The Seller cannot rule out temporary suspension of the Store in specific cases, such as maintenance, inspections, equipment replacement, upgrades, expansions, failures, technical issues, server changes, or changes in the Store’s operator.
