The online/ internet Shop is operated by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k. with its registered office in 136 Radziwiłłów Str, 32-084 Aleksandrowice, entered into the Register of Entrepreneurs of the National Court Register by District Court for Kraków- Śródmieścia in Krakow, XI Economic Department of the National Court Register under number: 0000695288, NIP: 6772425429, REGON: 368291794, BDO: 000144377.
I. Definitions
The terms used in the Regulations mean:
Seller / Guarantor - SELKEA Spółka z ograniczoną odpowiedzialnością sp.k. with its registered office in Radziwiłłów Str. 136, 32-084 Aleksandrowice, entered into the Register of Entrepreneurs of the National Court Register by District Court for Kraków- Śródmieścia in Krakow, XI Economic Department of the National Court Register under number: 0000695288, NIP:6772425429, REGON: 368291794, BDO: 000144377.
Internet shop/ store / Shop– the website through which the sale of goods takes place, operating at the website address provided in the Sales Schedule. In transactions there is no presence of any of the parties, and the Internet is used to make the sale.
Customer – a natural person, legal entity or organizational unit not being legal person which have been granted the legal capacity by virtue of statutory law, which places an Order in the Store.
Civil Code – Act of 23 April 1964 - Civil Code (Journal of Laws No. 16, item 93), as amended.
Regulations – these Regulations for the provision of electronic services.
Products – Equipment within the meaning of the Agreement. Used products have a gradation of visual and technical condition. Depending on the assessment by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k. they bear the appropriate gradation A+, A, A/A-, A-, A/B, B and a detailed description of differences between the gradations. The photographs of all Products are for illustrative purposes only and do not show the actual condition and appearance of the Products. Information about the Products given on the Store's website, in particular their descriptions, technical and utility parameters and prices, constitute an offer within the meaning of the Civil Code.
Sales schedule / Employee sales schedule – a document sent to the client's employer no later than on the working day preceding the start of the Store, specifying: the address of the website through which the sale of the Products takes place and the dates of beginning and operating of the Store.
Sales Agreement – a contract of sale of Products within the meaning of the Civil Code, concluded between the Seller and the Customer, using the Store's website.
Act on Consumer Rights – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827), as amended.
Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204), as amended.
Order – a statement of the Customer's will, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Products. Placing an order by the Customer means the immediate conclusion of a contract. The Customer, by filling in the order form, accepts an offer to purchase a specific item.
Shopping card – a type of form, by means of which the Customer places an Order.
Registration – sending personal data in order to create an Account. Simultaneous acceptance of the possibility of data processing for the purpose of order execution by companies cooperating with SELKEA Spółka z ograniczoną odpowiedzialnością sp.k.
Account – a profile created after the Registration activity. The Account may be private or corporate. The Account enables the purchase of Products. The name of the Account is invariable and irremovable.
Price – the cost of purchasing the Products. The Price does not include the cost of delivery of the Products. The price is expressed in gross version including the current VAT rate.
Cost of delivery – the entire cost of delivery of the purchased Products to the Customer, variable determined by the Shop website in the Shopping cart section.
Guwarantee – activities and time during which the Customer receives technical support from the Seller/Guarantor.
II. General provisions
2.1. These Regulations set out the rules for using the online Shop.
2.2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
2.3. The online/ internet Shop is operated by SELKEA Spółka z ograniczoną odpowiedzialnością sp.k with its registered office in Radziwiłłów Str. 136, 32-084 Aleksandrowice, entered into the Register of Entrepreneurs of the National Court Register by District Court for Kraków-Śródmieścia in Krakow, XI Economic Department of the National Court Register under number: 0000695288, NIP: 6772425429, REGON: 368291794, BDO: 000144377. The owner is also entitled to property rights, including copyrights. Photos of the Goods, descriptions, signs and other elements of the website are the property of Shop and have an advertising character. Using them without the consent of the owner is prohibited and may result in legal consequences.
2.4. The use of the online Shop is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
a) Internet Explorer version 8.0 or higher with Java support enabled, or
b) Chrome version 14 or higher with Java support enabled
c) minimum screen resolution: 1280 x 1024 pixels
d) active e-mail account otherwise e-mail address e.g. xxx@xxx.pl
2.5. Before performing the Registration and Order activities, the Customer is obliged to read these Regulations.
2.6. Post-lease/ used Products: The Seller shall ensure their correct functioning, unless the content of the advertisement states otherwise. The Seller guarantees the quality of the Products to the Customer for the period of 12 months from the date of releasing the Products to the Customer, unless the content of the announcement states otherwise and subject to the provisions of point 7.6.5 of the Regulations.
2.7. Prior to releasing the equipment for the purpose of repair (taking advantage of the Guarantee), the Customer should create a backup copy of the data from the hard disc or other mass storage medium storing the data.
2.8. Customers may access these Regulations at any time via a link on the home page of the service.
III. Registration in the Shop
3.1. Registration in the Store in order to set up a Customer Account shall take place by creating an Account with a startup password by the Seller or by completing the registration form by the Customer. The appropriate fields include your name and surname, e-mail address, establish your password, specify the nature of your account (company/private) and accept the Regulations.
3.2. The account is the property of the Customer. You shall not make your Account available to third parties. In the case of companies, the Account may be made available within the scope of internal company regulations.
3.3. Registration in the Shop and use of its functions is free of charge.
3.4. After completing the Registration process in the Shop, logging in to your Account shall be done via: Login/E-mail and the password established during the Registration process.
3.5. The Shop makes it possible to delete the Customer's Account from the Shop. To do so, an e-mail should be sent to the e-mail address info@selkea.pl with all the Account details.
IV. Order processing
4.1. The order of the Products from the Shop can be made via an Account.
4.2. Placing an order via an Account is associated with using the Shopping cart function. The Customer shall order the Products indicated by him/her from the Shop website and then click the "add to Shopping cart" button. The website automatically redirects the Customer to subsequent stages, in which the Customer specifies, in particular, the content of the Cart, specification of the Products, accepts the price of the Products, chooses the form of delivery, accepts the Price of the Delivery Cost, indicates the Delivery Address, chooses the form of Payment and confirms the completion of the order both through the website and the link sent to the e-mail address provided during the registration process.
4.3. An order made by the Customer using an Account is an expression of the Customer's will to conclude a contract and pay for the Products. The moment of concluding a Sales Agreement is the moment of concluding the purchase and sale agreement is the placement of the Order by the Customer.
4.4. The Products are sent and delivered through an external courier company DPD, Inpost. The cost of delivery shall be covered by the Customer. Delivery of the goods shall take place only in Poland.
4.5. Proof of purchase - fiscal receipt or VAT invoice. Added for each shipment. It also constitutes a guarantee document.
4.6. Purchases in the Shop can be paid in the following ways (to choose from):
a) by transfer to a bank account on the basis of a proforma invoice / Customer's order or on the basis of the Order number, using the following data:

b) via the online payment link from the Store's website.
4.7.1. Placing an Order by a Consumer involves the voluntary provision of personal data:
- name and surname
- address
- e-mail address
- telephone number
4.7.2. Placing an Order by a Customer who is not a Consumer involves the voluntary provision of personal data:
- company name and NIP number
- name of the person placing the Order
- company address
- e-mail address
- telephone number
4.7.3. The products shall be delivered to the Customer as soon as possible, if possible, in any case, within five (5) working days of the Customer placing an Order.
V. Withdrawal from the Agreement
5.1. A Customer who, according to the Act on Consumer Rights, is a Consumer making a purchase in the Shop may withdraw from the Sales Agreement without giving any reason within 14 days from the date of taking possession of the products, except for:
- the equipment that was delivered separately, in batches or in parts. In this case, the time limit begins from the acceptance of the last batch/part,
- regularly supplied for a contractually agreed period of time, the withdrawal period shall begin from the first possession of the first item/part/batch.
5.2. The Consumer shall return the equipment to the Seller on his own, at his own expense, not later than 14 days from the date of withdrawal from the Agreement. The Consumer shall bear only direct costs of returning the Products to the Seller.
5.3. The Consumer shall be liable for reduction in the value of the Products resulting from the use of the Products in a manner exceeding the one necessary to determine the nature, characteristics and functioning of the Products, unless the Seller has not informed the Consumer about the right to withdraw from the Agreement in accordance with legal regulations.
5.4. The Shop shall return all payments made by the Consumer after receiving the Consumer's statement of withdrawal from the Agreement and after receiving the Products back or providing the Consumer with a proof of its return, whichever is the earlier. The Shop shall return the payment using the same method of payment as the Consumer, unless the Consumer has expressly agreed to another method of return that does not involve any costs for the Consume.
5.5. The Seller may withhold the return of payment until receipt of the Products or until delivery of the proof of their return, whichever is earlier. The Products shall be sent back or transferred to the address of SELKEA Spółka z ograniczoną odpowiedzialnością sp.k. Radziwiłłów 136, 32-084 Aleksandrowice, immediately, and in any case no later than 14 days from notification of withdrawal. The deadline is met if the Products are sent back within 14 days.
VI. Complaints
6.1. The condition for making a complaint is sending the Products to the address of SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., Radziwiłłów 136, 32-084 Aleksandrowice.
6.2. The Customer shall be obliged to check, in the presence of the person delivering the equipment, the condition of the Products, in particular the quantity, completeness, compliance with the Sale Agreement of the ordered Products. In case of finding any technical defects or damages during transport, the Customer shall be obliged to draw up a damage report with information on its scope. The protocol must be signed by the Customer and the entity that delivered the Products. After the situation has occurred, the Customer should immediately contact the Shop staff.
6.3. The keyboard layout other than the one accepted in Poland does not constitute a defect of the Products and is not subject to complaint.
6.4. The photographs on Shop webside cannot be the basis for complaint about the Products.
6.5. The Customer's complaint will be processed by the Seller within 14 days from the receipt of the complete claim form. If there are any deficiencies in the submission, the Seller will immediately inform the Customer and provide instructions on how to address them.
VII. Guarantee
7.1. The time of repair of the equipment by the Guarantor is up to 14 working days from the moment of collecting the goods by the Guarantor at the address indicated above, i.e. SELKEA Spółka z ograniczoną odpowiedzialnością sp.k., Radziwiłłów 136, 32-084 Aleksandrowice. This time may change due to the availability of parts for reasons beyond the Guarantor's control. This time may also be extended as a result of detection of concealed information about flooding, interference of third parties or other causes complicating the repair of the equipment.
7.2. The Client's equipment may be reported to the Guarantor through the internal sales platform or sent to info@selkea.pl.
7.3. The guarantee entitlements are limited to the request to repair only the basic computer base elements, i.e. mainboard, processor, memory, disc, graphics cards and LCD matrix, excluding mechanical damage.
7.4. Backups should be made by the Customer before handing over the device for repair. The Guarantor shall not be liable for the consequences of possible restoration of factory settings and updating the software delivered for the repair of the Products.
7.5. The Guarantor's guarantee does not apply in case of repairs with parts delivered by the Customer. The guarantee also excludes repairs of motherboards damaged due to contact with liquid.
7.6.1. The guarantee excludes mechanical damage to the device, damage caused by flooding, dampness, damage caused by temperature and other factors of parameters not allowed by the producer, unreconciled repair attempts and damage caused by factors or subassemblies of which the Customer did not inform the service centre about the incorrect operation, if the above events occurred after the Products were delivered to the Customer.
7.6.2. The condition for using the guarantee is to report the problem within 14 days of its occurrence but not later than on the last day of the guarantee.
7.6.3. The Customer, upon handing over the equipment, shall receive a written confirmation of acceptance of the equipment for repair. In case of any doubts concerning the personnel of the person collecting the equipment, the confirmation is a document necessary to collect the equipment.
7.6.4. The Guarantor shall be liable for damages to the Customer due to non-performance or improper performance of obligations under the guarantee, unless such non-performance or improper performance is a consequence of circumstances for which the Guarantor is not responsible.
7.6.5. The 12-month guarantee covers the products on the site with the exception of:
- products in class B
The Seller provides a 6 month warranty for products in class B, unless otherwise stated on the product sheet.
- printers
The Seller provides a 6-month guarantee on printers.
- batteries for laptops, phones and other devices
The Seller does not provide any guarantee for batteries.
7.6.6. The Customer, by giving the equipment for repair, voluntarily accepts these regulations.
7.6.7. In case of an unjustified complaint, the Service may charge the Customer with costs of tests, transport, time spent or expertise.
7.6.8. The Guarantee applies only to Poland.
7.6.9. The Guarantee period shall commence from the date of delivery of the Products to the Customer and shall continue in accordance with the information on the Products' card or pursuant to these Regulations. The Guarantee period shall be extended by the time of documented repair.
7.6.10. In case of used Products, the Seller shall be liable under warranty if a physical defect is found before the lapse of one year from the date of release of the Products to the Buyer. In the remaining scope, in case of Customers - Consumers, the guarantee does not exclude, limit or suspend the rights of the Customer resulting from the provisions on the warranty for defects of the Goods. The warranty is excluded for Entrepreneurs.
VIII. Personal Data
8.1. The customer provides his or her personal data voluntarily but they are necessary to provide services to the customer.
8.2. The Seller shall process personal data in order to provide services in various forms, including electronically. The Seller may make the data available to a third party in order to perform the Sale Agreement of the Products. The Seller shall have the right to send commercial information to the Clients by electronic means, after fulfilling the conditions resulting from the legal regulations.
8.3. The Client has access to his personal data. It has the right to correct and delete them. The personal data may be corrected or deleted after logging into the Client's account or by contacting by e-mail.
8.4. At the request of the justice authorities or entities entitled to personal data of the Clients, the personal data may be made available by the Seller.
IX. Final provisions
9.1. Settlement of possible disputes arising between the Seller and the Customer, who is a consumer within the meaning of Article 221 of the Civil Code, shall be submitted to the court having jurisdiction in accordance with the provisions of the Civil Procedure Code.
9.2. Settlement of possible disputes arising between the Seller and the Customer who is not a consumer within the meaning of art. 221 of the Civil Code shall be submitted to the court having jurisdiction over the seat of the Seller.
9.3. In matters not regulated by these Regulations, the provisions of the Civil Code, provisions of the Act on the provision of services by electronic means and other relevant provisions of Polish law shall apply.
9.4. The Seller has the right to amend the Regulations.
9.5. The Seller shall make every effort to ensure that the services provided by him are at the highest level. The Seller cannot exclude temporary closure of the Store in special cases such as the need for maintenance, inspection, equipment replacement, modernisation, expansion, failure, technical problems, server change, change of the Store operator.
